1. About these terms
These terms govern use of DrivingMarket by learner drivers, driving schools and instructors. By creating an account, posting a request, making an offer or buying membership, you agree to them. If you act for a business, you confirm that you have authority to bind it. You must be at least 17 years old to use the learner marketplace.
2. Our marketplace role
DrivingMarket introduces learners to independent driving schools and instructors. We do not provide driving instruction, employ instructors, guarantee availability or become a party to any lesson agreement. Learners and schools are responsible for checking each other’s suitability and agreeing lesson dates, cancellations, packages and payment directly.
3. Accounts and accurate information
You must provide accurate, current information, keep any access code or account link secure and tell us promptly if you suspect unauthorised access. You are responsible for activity carried out through your account. We may ask for information reasonably needed to verify an account, school or instructor.
4. Learner requests
Learners may post only genuine requests for themselves or someone they are authorised to assist. Requests normally remain open for 48 hours and may receive offers from up to 20 schools. A learner may close or extend a request and remains free not to select an offer. Do not include sensitive medical, financial or identification information in free-text notes.
5. School eligibility and responsibilities
Schools and instructors must provide accurate business and ADI details, hold all licences, registrations, insurance and permissions required for their work, keep availability and prices current, and comply with applicable road-safety, advertising, equality and data-protection law. They must use learner information only to respond to the relevant request and arrange instruction.
6. Offers and one lower rebid
Each participating school may make one opening offer and one lower-price revision for each learner request. A revision must reduce the earlier hourly price. Offers must state any material conditions. Misleading headline prices, hidden mandatory charges, fake availability, pressure selling, coordinated bidding and attempts to manipulate the marketplace are prohibited.
7. Lesson bookings and payments
An offer is an invitation to arrange lessons, not a guaranteed booking. The learner and school form their own agreement when they confirm a booking. DrivingMarket does not currently collect lesson fees and is not responsible for lesson quality, cancellations, refunds or disputes between learner and school. Any statutory rights a learner has against a school remain unaffected.
8. School membership and renewal
School membership is a business subscription billed annually through Stripe. The first annual term costs £25 when the subscription begins by 31 October 2026, £50 when it begins between 1 November 2026 and 31 October 2027, and £80 when it begins on or after 1 November 2027. The price in force on the renewal date applies to renewal, and we will give reasonable advance notice of a material price change.
Membership renews automatically each year unless it is cancelled before the renewal date. You may cancel future renewal at any time by emailing hello@drivingmarket.co.uk; access continues until the end of the paid term. Fees are non-refundable once a term has begun except for duplicate or erroneous charges, where the law requires otherwise, or where we agree at our discretion. The Stripe checkout shows the total payable. If VAT becomes chargeable, the checkout and invoice will state it before payment.
9. Acceptable use
You must not use DrivingMarket unlawfully; harass another user; scrape, resell or harvest data; upload malicious material; impersonate another person; evade account restrictions; interfere with the service; or use learner details for unrelated marketing. We may remove content or restrict access where reasonably necessary to protect users, the marketplace or our legal obligations.
10. Profiles, logos and other content
You retain ownership of content you submit. You give Falcon Creative Ltd a non-exclusive, worldwide, royalty-free licence to host, resize, display and otherwise use that content only to operate, promote and improve DrivingMarket. You confirm that you have the rights needed to submit it. We may remove content that is unlawful, misleading or infringes another person’s rights.
11. Safety, reports and suspension
Users may report suspicious, abusive or misleading conduct. We may investigate, request evidence, preserve relevant records, suspend or close accounts and cooperate with lawful requests. Learners should independently confirm an instructor’s identity and current DVSA status before booking. We may suspend or end access immediately for serious safety, fraud or legal concerns, or on reasonable notice for other material breaches.
12. Service availability and third parties
The service may change, be interrupted or contain errors, particularly during the pilot. We do not guarantee a minimum number of requests, offers, bookings, hires or earnings. Stripe and other third-party providers operate under their own terms and may experience outages outside our control.
13. Liability
Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Subject to that, Falcon Creative Ltd is not liable for indirect or consequential loss, loss of profit, business, opportunity, goodwill or data, or for acts and omissions of learners, schools, instructors or third-party providers. For a school or other business user, our total liability arising in any 12-month period is limited to the membership fees paid to us by that user during that period.
14. Changes, transfer and ending these terms
We may update these terms to reflect service, legal or security changes. Material changes will be notified on the site or through available contact details before they take effect. You may stop using DrivingMarket at any time; cancelling membership is covered in section 8. We may transfer our rights and obligations as part of a reorganisation or sale, provided this does not materially reduce your rights.
15. Governing law and contact
These terms are governed by the law of England and Wales. The courts of England and Wales have jurisdiction, except that a learner acting as a consumer may also have mandatory rights to bring proceedings in another part of the United Kingdom.
